ORDINANCE 113 - Parks and Recreation Council

This Ordinance supersedes the previous Ordinance 49 and all amendments thereto.

Section 113-1.

Purpose

Pursuant to Section 402N of the Berwyn Heights Town Charter, the Council of the Town of Berwyn Heights grants the authority for the continued existence of Parks & Recreation Council to serve as an advisory body to the Town Council for the purpose of planning, developing, and maintaining recreational areas and facilities, planning and conducting recreation programs and events, and assisting in representing the Town before other recreational bodies.
 

Section 113-2. Membership Qualifications

Membership on the Parks & Recreation Council shall be composed of the following:

A. One (1) Councilman

B. One delegate from each organization having requested and received formal recognition by the Town Council.  In order to qualify for recognition, organizations must be founded in Berwyn Heights.  Delegates must be residents of Berwyn Heights during the term of their appointment.

C. One representative of the Maryland National Capital Park & Planning Commission.

D. The Town Council of Berwyn Heights may annually appoint five (5) citizens at large as members of the Parks and Recreation Council.
 

Section 113-3. 

Parks & Recreation Council Rules

The Parks & Recreation Council shall operate under rules and regulations as it deems necessary.  These rules, however, shall provide:

A. Selection of a President, Secretary, and Treasurer of the Parks & Recreation Council.  The financial records of the Parks & Recreation Council shall be available for pubic inspection.

B. Terms of officers elected by the Parks & Recreation Council shall be for one (1) year commencing July 1.

C. Only delegates representing organizations in Berwyn Heights recognized by the Town Council and the citizens appointed by the Town Council shall exercise the privilege of voting on motions or recommendations executed by the Parks & Recreation Council.
 

Section 113-4.  Finances

A. The Parks & Recreation Council is authorized to recommend appropriations from the general revenues of the Town for the purchase of equipment, development of facilities, or conduct of recreation programs or special events within the Town.  Said appropriation recommendations shall be received by the Town Council on or before April 1, of each year and shall include an estimate of disbursements and a statement indicating how and when these expenditures will  be made.  All funds appropriated from the General Fund for use by the Parks & Recreation Council shall be approved and disbursed by the Town Council. 

B. All funds obtained by the Parks & Recreation Council from sources other than from the general revenues of the Town shall remain in the custody of the Parks & Recreation Council. 

C. Funds of the Parks & Recreation Council shall be expended only for purposes of Recreation, Education, or other Civic Affairs within the Town of Berwyn Heights, and disbursement of said funds shall be made as provided by the rules governing the Parks & Recreation Council, but in instance without the combined consent of less than the President and Treasurer of the Parks and Recreation Council. 

D. All equipment and properties purchased by Parks & Recreation Council shall be the property of the Town of Berwyn Heights.

Section 113-5.  Meetings

A. The Parks and Recreation Council shall hold a minimum of nine (9) regular monthly meetings per year. 

B. Any citizen may attend said meetings of the Parks & Recreation Council and shall be granted a reasonable opportunity to comment on any subject discussed. 

C. Said citizen may present a plan, program, or request a special recreation activity.  If action is not taken, or is denied by the Parks & Recreation Council, said citizen or organization may appeal to the Town Council for consideration and review.  The Parks & Recreation Council shall be required to implement the decision of the Town Council.

Section 113-6.  Dissolution

In the event the Parks & Recreation Council should cease to function, either by self-dissolution or by inactivity to be determined by the failure to conduct three (3) scheduled regular meetings, the Town Council may appoint members who shall act as a Parks & Recreation Council in accordance with Section 2D of this Ordinance.  In the event the Parks & Recreation Council should cease to exist, any remaining funds shall become the property of the Town of Berwyn Heights for recreation usage.
